The Giveaway is only open to legal residents of Canada, and only in areas where the Giveaway complies with local law. The drawing is void where prohibited. Employees and immediate family members of Franchise Direct USA, Inc. (a subsidiary of McGarry Internet, Ltd. – collectively “Franchise Direct” or “Promoter” herein), its affiliated companies, professional advisers, advertising and promotional agencies are not eligible to take part in the “Franchise Direct Customer Survey" Giveaway. Entrants must be over eighteen (18) years of age.
The survey will commence on March 10. Entry into the Giveaway is made by entrants completing and submitting the relevant survey on SurveyMonkey.com. There will be a total of one (1) gift card for Amazon to the value of $100 given away (“the prize”). The odds of winning are dependent on the number of entries made and, therefore, incapable of calculation.
There is no cash alternative to the prize, and the Promoter shall have the right to substitute the prize being offered with one of equal or greater value. The prize winner (and not the Promoter) shall be responsible for the payment of all applicable taxes incurred by them related to the receipt of any prize they win in the Giveaway. Entry to the Giveaway shall be limited to entrants who have Internet access prior to the start of the Giveaway. Each entrant is limited to one successful entry. The decision of the Promoter is final and no correspondence will be entered into. The Promoter accepts no responsibility for prizes lost or delayed in delivery.
Each of the winners will be notified by online message via email no later than five (5) days after the Giveaway drawing and may be required to complete and return a form by fax or email to the Promoter to confirm their eligibility (e.g. proof of age, residence) to participate in the Giveaway within five (5) days of notification that they have won. If a winner fails to return the form within the time stated, or is found to be ineligible for any reason, a further winner will be selected in their place. The winner will be deemed to consent to the use of their name, likeness and image for publicity purposes without further compensation. The winner's name will be available on request from Franchise Direct by sending an email to info@franchisedirect.com.
The Promoter does not accept responsibility for: (1) lost, late or undelivered entries, notifications or communications; (2) any technical, computer, online, telephone, cable, electronic, software, hardware, transmission, connection, Internet, Website (including www.surveymonkey.com), or other access issue, failure, malfunction or difficulty that might hinder the ability of an entrant to enter the Giveaway; or (3) for any event which may cause the Giveaway to be disrupted or corrupted. Entrants who tamper with the Giveaway in any way will be disqualified.
The Promoter disclaims any liability for inaccurate information, whether caused by the Website, users, equipment used in the Giveaway, or by human or technical errors related to the submission of entries. The Promoter makes no warranties or guarantees in relation to the prize or the information or advice contained therein.
Entrants agree that the Promoter and its shareholders, officers, directors, agents, suppliers and employees shall not be liable for losses or injuries of any kind resulting from acceptance or use of prizes, or participation in drawing. In no event shall the Promoter be liable for any damages whatsoever (including, without limitation, direct, indirect, special, incidental, consequential, punitive or similar damages) arising from any use of the Prize or for any claim made against the Promoter by any person using this Prize.
No purchase is necessary to enter the Giveaway. Information submitted by Entrants to the Giveaway will only be used by Franchise Direct in accordance with its privacy policy and as otherwise stated.
The Promoter may cancel, terminate, modify or suspend the Giveaway or these Terms and Conditions prior to the cessation of the Giveaway for any reason, including for technical reasons such as computer viruses, bugs, tampering or technical failures, or any other factor beyond Promoter’s reasonable control impairs the integrity or proper functioning of the contest, as determined by Promoter in its sole discretion.
By entering the Giveaway, entrants agree to be bound by these Terms and Conditions which are governed by the laws of the United States. The Promoter and all entrants irrevocably agree that the courts of the United States shall have exclusive jurisdiction to settle any dispute which may arise in connection with these Terms and Conditions or the Giveaway and submit all such disputes to the jurisdiction of the United States, provided that for the exclusive benefit of the Promoter, the Promoter shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of an entrant’s residence.
